Deportation is the result of any unlawful act committed against the laws and rules of any country. There are several reasons why aliens or sometimes even those who have already acquired citizenship could still be a subject to deportation if they commit any crime or found out to have committed a crime to gain their citizenship or permanent residency certificates and visas. 

In the United States of America, these are the steps in deportation:

1. Issuance of Order to Show Cause- This State document is an establishment of reasons why the government is deporting the person subject for deportation. Usually, the person/s concerned is detained and can be released by posting bond.

2. A date for a hearing before an immigration judge is issued. The government has a legal representation and the person in question is not legible for any free legal representation or any representation is at no cost to the government; however, PRO BONO or legal agencies who work for reduced fees are available.

3. The judge will hear the evidence on both sides and will make a ruling. The ruling may be or can be appealed by both sides to the BIA. (Board of Immigration Appeals)

4. Any losing side can appeal through FEDERAL COURTS. Financial matters determine the ability of the alien to further the case or not.

Voluntary Departure

If and when chances are slim (often determined by an immigration lawyer or adviser) voluntary departure is more likely to happen. This will minimize the fear of not being able to go back to the United States in the future in the event of a change in circumstances. Deportation will cause a magnified no chance of going back to the United States. Voluntary deportation is usually the final step to lessen the stigma. The person who departures voluntarily will shoulder the travel expenses and must be of good moral character. 

Inadmissible Aliens

There are some potential immigrants addressed as INADMISSABLE ALIENS who are barred from entering the United States as immigrants, refugees, or asylum seekers due to failure of necessary requirements. 

The following reasons for inadmissibility include:

• Communicable diseases- AIDS, Tuberculosis, typhoid fever and other serious ailments and/or easily transmitted are not allowed to emigrate unless a WAIVER is issued and/or a certificate for being cured and free from any communicable disease is issued by a legitimate body.

• Criminal record- Those who have committed crimes classified as aggravated felonies are most likely denied admission to the United States. People who committed serious crimes such as rape, murder, drug trafficking, treason, espionage, terrorism are often denied admissions unless the person concerned can prove to a judge that his/her crime was not serious or the charges have been cleared in their country of origin.

• Physical and mental disorders- Certain conditions can be a reason not to be allowed to the United States unless the condition in question has been cured or is under control. 

• Terrorist and or espionage threat- Anyone deemed likely to engage in any subversive acts against the United States will be denied access or entry to the United States.

Expedited removal is a process under Illegal Immigration Reform Act; in this process, anyone who do not possess legal documents of entry to the United states and or obtained fraudulently or counterfeited are subject to expedited removal.
